Terms of Sale

Last updated: 2 November 2026

Article 1 : Purpose and Definitions

These Terms of Sale govern all contractual relations between BINYAN CHALEM, publisher of the KOUCHTA brand ("the Seller"), and any person purchasing products on kouchta.com ("the Customer").

Definitions: "Products" means jewelry in 18K gold 925 silver plated with 18K gold and moissanite sold under the Kouchta brand. "Moissanite" means a stone grown in laboratory, offering superior brilliance to diamond with hardness of 9.25 on the Mohs scale.

Article 2 : Acceptance

Validating an order implies full acceptance of these Terms. The Seller reserves the right to modify the Terms at any time, the applicable version being the one in force on the order date.

Article 3 : Product Description

Products are jewelry in 925 silver plated with 18K gold, set with moissanite. Photos and descriptions are indicative. Slight variations may exist between individual stones.

Article 4 : Price and Payment

The amount currently charged to the card is in shekels (ILS). Any euro equivalent shown on the website is indicative. The ILS amount payable is displayed before final confirmation. Your bank or card issuer may apply its own exchange rate and fees.

Shipping charges are shown before the order is confirmed. Import VAT, customs duties, clearance and handling fees not expressly collected at checkout are additional, payable by the Customer, and may be requested by customs or the carrier before delivery. Amounts depend on the country, order value and goods, and carrier charges. Read the shipping policy before purchasing.

Payment is due when ordering, using the payment methods displayed at checkout.

Article 5 : Shipping

Available destinations, shipping charges and the applicable delivery estimate are shown at checkout. Unless a different time has been agreed, delivery must take place no later than 30 days after the contract is concluded. Statutory remedies for late delivery remain available.

For delivery arranged by Kouchta, risk passes when the Customer or their nominated third party, other than the carrier, physically receives the goods, subject to statutory exceptions. Partner liability exclusions do not remove the Seller’s obligations. See the shipping policy.

Article 6 : Claims and Returns

EU consumers may notify withdrawal for eligible goods within 14 days of receipt without giving a reason. Goods must then be dispatched back within 14 days of that notification. Direct return shipping costs for a change of mind are paid by the Customer.

Amounts due must be reimbursed within 14 days of notification. Reimbursement may be withheld until receipt of the goods or proof of dispatch, whichever occurs first, unless the Seller offered to collect the goods. Original standard delivery is reimbursed when withdrawing from the entire order.

A defect or damage report after 48 hours or 7 days does not extinguish statutory rights. Photos are helpful but are not a general condition for exercising those rights. There is no blanket withdrawal exclusion for all earrings. Full conditions and legal exceptions appear in the returns policy.

EU consumers have a statutory conformity guarantee lasting at least two years from delivery, subject to applicable national rules and independently of any commercial guarantee. Statutory remedies and necessary conformity costs are not limited by supplier terms.

Article 7 : Liability

Nothing in these Terms limits mandatory consumer rights, statutory guarantees, the Seller’s obligations for loss, damage or non-delivery, or liability that cannot lawfully be excluded. Compensation caps and exclusions imposed by suppliers or carriers do not cap the Customer’s statutory remedies against Kouchta.

Article 8 : Intellectual Property

The KOUCHTA brand and all site content are protected by intellectual property laws. Any reproduction without authorization is prohibited.

Article 9 : Applicable Law

These Terms are governed by the law of the Seller’s country of establishment, without depriving consumers of mandatory protections available under the law applicable in their country of habitual residence. Nothing in these Terms excludes a court jurisdiction or remedy that consumers are entitled to under applicable mandatory rules.
